Article
The client, MD, approached me several months ago after becoming the subject of two non-clinical investigations by the General Pharmaceutical Council (GPhC). Having received a referral and undertaken considerable research into representation options, he was clear about the outcome he wanted to achieve. Together, we developed a strategy focused on presenting compelling evidence and addressing the allegations directly and methodically.
From the outset, MD’s cooperation and commitment to the process were instrumental. He provided clear instructions and responded promptly to requests for evidence, allowing us to challenge the regulator’s case at every stage.
Our first detailed submission resulted in the GPhC withdrawing its application for an Interim Order. Following a second round of representations, the regulator requested that the matter be listed before a Principal Hearing so that it could apply to withdraw all allegations in their entirety. Working constructively with the GPhC, we supported this process, and, following a hearing, all allegations were dismissed.
Fitness to practise defence barrister, Stephen McCaffrey, said:
“This outcome was particularly significant given that the GPhC had exercised its powers to bypass the Case Examiners and refer the matter directly to a full fitness to practise hearing. In these circumstances, securing the withdrawal and dismissal of all allegations represented the most effective and direct route to bringing the proceedings to a complete end. Throughout the case, MD understood the importance of receiving honest advice, agreeing a clear strategy and remaining committed to that approach, regardless of the inevitable challenges and uncertainties that arise during regulatory proceedings. I was delighted to secure this result. The case concluded with all allegations dismissed, enabling MD to continue his professional career without any adverse findings or blemish on his regulatory record.”
MD said:
“Stephen McCaffrey went above and beyond from start to finish. He took the time to explain everything clearly, provided exceptional support throughout, and demonstrated genuine care for my case. I would wholeheartedly recommend him to anyone seeking expert legal representation.”
