A pharmacist facing serious regulatory action in the online pharmacy sector has avoided removal from the register after the General Pharmaceutical Council’s (GPhC) Fitness to Practise Committee accepted defence submissions and imposed a suspension instead.
The case involved a wide‑ranging and technically complex set of allegations relating to online pharmacy practice. Drawing on extensive experience in the sector, the defence team narrowed the issues, focused the case strategy, and prepared the matter for a Principal Hearing — an outcome that was unavoidable given the seriousness of the concerns.
The registrant accepted from the outset that regulatory action and a sanction were inevitable. The central focus of the defence was therefore resisting the GPhC’s request for removal. After hearing evidence and submissions, the Committee agreed that removal was not justified. Taking account of the pharmacist’s insight, remediation and fundamentally changed practice, it imposed a period of suspension.
Fitness to practise defence barrister Stephen McCaffrey said:
“The focus was on winning against the GPhC request for removal. The Committee agreed with us and, taking account of his insight and remediation, alongside his fundamentally changed practise, imposed a suspension. Our client was delighted and we were equally delighted for him. “
Our client said:
“Stephen McCaffrey provided calm, strategic and highly skilled representation in an exceptionally serious and complex GPhC fitness to practise case, quickly mastering the detail, identifying the real issues and presenting them with clarity and persuasive force. His advocacy was measured and effective, challenging evidence where necessary and ensuring the Committee understood the full context and mitigation. Throughout, his judgement stood out: he was realistic, never offered false reassurance, and helped me navigate the strengths and risks of my position with honesty and care. His professionalism and genuine support made an intensely stressful process manageable, and I would strongly recommend him to any healthcare professional facing regulatory proceedings.”
